The IDOC says it received an anonymous tip on the whereabouts of David Person who was spotted walking near the intersection of Cole Road and Overland Road in Boise at about 10 p.m. Wednesday. He was taken into custody without incident.
He was sentenced to up to 10 years in prison last year, however, a judge suspended his sentence and ordered him released March 13.
The IDOC says Persons, 33, was wanted for failing to maintain contact with his probation officer.
Officials say Persons was drunk at the time of the crash.
The Boise County Sheriff's Office says Pearl Sittner, 4, of Boise, was in the SUV with four other family members when it went off the road and slid 90 feet down an embankment before stopping.
The girl's parents were able to get two other children out of the SUV, but were unable to reach Pearl before the SUV broke loose and slid another 60 feet down the embankment into the water.
He has a violent history including convictions for battery on a law enforcement officer and arson.
